# MEDDPICC trademark: court ruling in MEDDICC Ltd v. 01 Consulting LLC (E.D. Pa., 2026) > On 21 April 2026, Chief Judge Wendy Beetlestone of the United States District Court for the Eastern District of Pennsylvania held that MEDDPICC is a generic term for business education services and content and ordered the Director of the USPTO to cancel U.S. Trademark Registration No. 6,489,058 for MEDDPICC under 15 U.S.C. § 1119. Case No. 2:24-cv-01836-WB. This site publishes the public court record. Last updated: 2026-10-24. ## What the court ordered (Order, ECF No. 100, 21 April 2026) - Entered a declaratory judgment of non-infringement in favor of MEDDICC Ltd. - Dismissed the defendants' trademark counterclaims with prejudice. - Directed the Director of the USPTO to cancel U.S. Trademark Registration No. 6,489,058 for MEDDPICC, pursuant to 15 U.S.C. § 1119, on the ground that the term is generic. - Denied MEDDICC Ltd's motion for summary judgment in all other respects. The Order identified three MEDDICC Ltd claims remaining for trial: interference with contractual relations, interference with prospective contractual relations, and trade libel. ## Key findings (Opinion, ECF No. 99) - MEDDPICC was coined in 2005 and represents a multi-step framework used by sales professionals to evaluate, manage, and ideally win business. Defendant Darius Lahoutifard was not involved in its conception and federally registered the term sixteen years later (p. 1). - Registration No. 6,489,058 issued in September 2021 (p. 4). - MEDDPICC's primary significance to sales professionals is to name a type of sales qualification methodology; the term is generic for business education services and content (pp. 28, 31). - The evidence did not show use of MEDDPICC in a trademark sense or that the relevant public primarily understands MEDDPICC to name a producer (p. 31). - A generic term cannot receive trademark protection, even if it has acquired secondary meaning (p. 31 n.14). - Cancellation is appropriate where a term is found to be generic (pp. 31-32). ## Facts - Court: United States District Court for the Eastern District of Pennsylvania - Judge: Wendy Beetlestone, Chief Judge - Case: MEDDICC Ltd v. 01 Consulting LLC d/b/a MEDDIC Academy and Darius Lahoutifard, Case No. 2:24-cv-01836-WB (Civil Action No. 24-1836) - Date: 21 April 2026 - Filings: Opinion, ECF No. 99 (33 pages); Order, ECF No. 100 (3 pages) - Registration: U.S. Trademark Registration No. 6,489,058, MEDDPICC (Serial No. 88845076) - Legal basis: 15 U.S.C. § 1119; 15 U.S.C. § 1064(3) - Status: certain claims remained pending after this ruling.
